The Ministry of Defense explained that with partial mobilization, the norm of the law “On mobilization preparation and mobilization” on the ban on the departure of persons liable for military service without the permission of the military registration and enlistment office does not apply, said the speaker of the State Duma Vyacheslav Volodin.
Earlier on Thursday, he said that although conflicting information about travel restrictions was published on various information resources, the federal law on mobilization should be guided. It says that citizens registered with the military cannot leave their place of residence without a certificate from the military commissariat.
Senator Andrei Klishas then wrote on his Telegram channel that, according to the law “On the procedure for leaving the Russian Federation and the procedure for entering the Russian Federation”, the ban applies only to those who have already received a summons. This document does not provide for restrictions during the period of mobilization for persons registered in the military but not yet called up for service. “If such a person left the Russian Federation during the period of mobilization, he violated the Federal Law “On mobilization …”, but did not violate the Federal Law “On the procedure for leaving the Russian Federation …”, — Klishas explained.
President Vladimir Putin, announcing partial mobilization, clarified in the corresponding decree that the draft would be carried out in accordance with the federal law “On mobilization”. However, the Ministry of Defense subsequently stated that partial mobilization does not provide for restrictions on the movement of citizens. The absence of a travel ban was discussed in the State Duma Committee on Defense and Rostourism. The government website “Explaining.rf”, which published, in particular, explanations on the topic of partial mobilization, also provides information about the absence of restrictions.
According to the head of the HRC Valery Fadeev, restrictions on the exit of people from Russia, who did not receive a summons would violate human rights.
At the same time, in some regions (for example, in the Omsk, Voronezh, Lipetsk regions), after the announcement of mobilization, the authorities imposed restrictions on the movement of those liable for military service. In the Kursk region, such a ban was lifted a few days after the introduction.
